Description
You have the right to "Opt In" to an Interconnection Agreement that Qwest has entered into with other Qwest CLEC customers. Qwest Interconnection Agreements available for "Opt In" may be obtained from State Commissions for your review.
If you would like to “Opt In” to another CLEC’s entire Interconnection
Agreement with Qwest, follow the process defined in Getting
Started as Facility Based Competitive Local Exchange Carrier
(CLEC)
- These agreements are posted for the information of other
CLECs. To the extent that these agreements contain ongoing
obligations on the part of Qwest to [the CLEC contract party].
Qwest will provide the same to other telecommunication carrier's,
upon reasonable request for the time that these agreements
remain in effect and subject to the same terms and conditions,
as well as, applicable policies with respect to the ability
of telecommunication carriers to opt into agreements under
Section 252(i) of the Telecommunications Act, which are
incorporated herein by reference. Selected provisions are
available for all CLECs to review and request as Opt Ins.
The selected opt in provisions are marked and bracketed.
The selected provisions are, in a broad sense, related to
an interconnection service or an Unbundled Network Element
(UNE) under Section 251 that represent current, ongoing
obligations and have not been superseded by other Agreements
or Commission orders, terminated or expired.
- A CLEC may request only those services that are being
provided to another CLEC under the posted agreement on a
going-forward basis. This offer does not apply to provisions
of these agreements that have expired, that involved payments
made in settlement of past disputes, or that involve matters
unrelated to Section 251(b) and (c) of the Telecommunications
Act.
- All of the requisites of Section 252(i) apply to a telecommunication
carrier's request for provisions posted herein. These include
the requirement to assume all legitimately related and mutual
obligations of the requested provision under Section 252(i).
Following are the Agreements by state:
Qwest has at all times operated in good faith in filing
with the state commissions Interconnection Agreements and
Amendments under Sections 252(a) and (e), and is committed
to full compliance with the Telecommunications Act of 1996.
Questions were raised regarding Qwest's decisions in this
area. As a demonstration of good faith, Qwest reviewed all
currently effective Agreements with CLECs to identify Agreements
containing provisions that relate to Section 251(b) or (c)
services on an on-going basis and which have not been terminated
or superseded by agreement, commission order, or otherwise.
Qwest believes that agreements identified under this review
process are beyond the scope of Section 252(a). For example,
the review process reaches details of business-to-business
carrier relations that Qwest does not think the Telecommunications
Act requires to be filed with state commissions for approval.
In an effort to resolve issues in this area, Qwest petitioned
the state commissions to approve such provisions such that,
to the extent any active provisions of such agreements relate
to Section 251 (b) or (c), they are formally available to
other telecommunications carriers under Section 252(i). Qwest
has marked, highlighted or bracketed those terms and provisions
in the agreements which Qwest believes relate to Section 251(b)
or (c) services, and have not been terminated or superseded
by agreement, commission order, or otherwise, and are thus
subject to filing and approval under Section 252.
This website displays those agreements containing the marked
provisions for review, and Qwest is offering other telecommunications
carriers any of the marked or bracketed terms pursuant to
the polices and rules of Section 252(i). Provisions that settle
past carrier-specific disputes, that do not relate to Section
251, or that are no longer in effect are not subject to Section
252(i) and this offering.
