Qwest Wireless® ("Qwest") Service Agreement ("Agreement")

IF YOU ACTIVATE OR USE THE SERVICE OR WIRELESS PHONE, YOU CONSENT TO THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT CONSENT, DO NOT ACTIVATE OR USE THE SERVICE. IF YOU ARE AN EXISTING CUSTOMER WITH ACTIVE SERVICE AND YOU DO NOT CONSENT, DISCONTINUE YOUR USE OF THE SERVICE AND CALL QWEST AT 1 800-879-0611 TO CANCEL YOUR SERVICE (SUBJECT TO SECTIONS 1 AND 3 BELOW).

This is an agreement between you and Qwest for wireless telecommunications service ("Service") and wireless receiving and transmitting equipment ("Wireless Phone"). The term "Service" includes any additional features and services that you may purchase from Qwest. For business customers, this Agreement governs both the business and the individual user of the Service. If you are an existing Qwest customer, this Agreement revises and replaces any prior agreements for your Service.

1. Return Policy. If you purchased your Wireless Phone directly from Qwest and wish to return it (and any related accessories) and cancel your Service, you may do so within 30 days of the date of activation as follows. For Internet and telephone purchases: Call Qwest at 1 800-244-1111 (business customers please call 1 800-603-6000) to request a return kit and additional instructions. If you purchased your Wireless Phone(s) at a Qwest retail location: Visit any Qwest retail location to cancel your Service and make your return. (For purchases from a seller other than Qwest, please see seller for return policy details.) Returns more than 30 days after activation will be at Qwest's sole discretion. A sales receipt or other proof of purchase is required for all returns, and the Wireless Phone, all included accessories, packaging materials and user manuals must be returned in their original condition. Upon receipt of your equipment and these materials, we will refund the purchase price or credit your account, as appropriate. Your activation fee is non-refundable once you have activated service, and you will be liable for all charges incurred from the date of activation through the date of deactivation. Any shipping charges are non-refundable.

2. Eligibility, Credit Check and Security Deposit. You authorize Qwest to investigate your credit history and report your performance to credit reporting agencies. To obtain and remain eligible for Service, you must satisfy Qwest's credit criteria. If Qwest becomes aware of any information regarding your credit history that Qwest, in its sole discretion, deems adverse (including but not limited to outstanding past due amounts with a Qwest affiliate or an unrelated third party), Qwest may refuse, limit, interrupt, or terminate Service. Depending on your credit history, you may be required to make an advance payment and/or pay a security deposit before activation of your Service. Advance payments and security deposits must be cash, credit card or certified funds. Security deposits will be held by Qwest and will accrue interest at the then-current rate and method established by the public utilities commission or similar regulatory agency for the state in which you reside until you have established 12 consecutive months of satisfactory payment history, unless you terminate your Service earlier. The deposit and accrued interest will be returned to you upon establishment of satisfactory payment history, unless you terminate Service earlier, in which case the deposit and accrued interest will first be applied to your final account balance, including any early termination fees, and any remainder will be returned to you.

3. Service Plans, Charges and Billing. Your Service is subject to the wireless price plan ("Service Plan") you selected when you placed your order. Your Service Plan is summarized in the Welcome or Confirmation letter and other documents provided by Qwest after activation of your Service, which are incorporated into this Agreement. Along with this Agreement, your Service Plan describes how your Service works and identifies the fees and charges or categories of charges applicable to your Service. Your Service Plan provides a specified number of monthly minutes you may use to make on-network calls in your Home Coverage Area (see section 4 below). All "minutes" for on-network calls are deducted or charged in full-minute increments, rounded up to the next minute, from initiation until you disconnect the call. Timing of roaming minutes is determined by the roaming carrier. Monthly minutes (and additional minute charges, if applicable) apply to calls to your voice messaging service, answering machine, and 1 800 numbers. Unused monthly minutes do not carry over to the following month.

a. Charges. You agree to pay all fees and charges related to your Service, whether set forth in your Service Plan, identified herein or otherwise incurred by you, including but not limited to the following:

• A non-refundable activation fee, if applicable.
• Recurring monthly charges for Service, plus taxes, regulatory surcharges, and $1.75 cost recovery fees per Wireless Phone ($0.50 for E911 and $1.25 for number pooling and portability).
• Per-minute charges for additional minutes used in excess of your monthly plan minutes (additional minutes for Home/Office Link are $0.50 per minute).
• Local toll and long-distance charges, if applicable. If your Service Plan includes long-distance, your monthly minutes may be used to make domestic long-distance calls from your Home Coverage Area if you are on the network; additional minute charges apply to such calls if you exceed your monthly minutes, and roaming charges plus long-distance charges apply to long-distance calls made while automatic roaming.
• Per-minute charges for automatic roaming (subject to section 4 below), if applicable. If your Service Plan includes automatic roaming, your monthly minutes may be used to make automatic roaming calls within the continental United States at no additional charge; additional minute charges apply to such calls that exceed your plan minutes.
• Any additional charges you incur for calls to Directory Assistance and other caller-pay numbers (such as 1 900 numbers) at the then-current rates for such calls.
• If you subscribe to a Service Plan for a set term (such as one year), a $200 deactivation fee applies if you terminate Service before the end of the term, as liquidated damages and not as a penalty, unless you are a new customer and you terminate in accordance with section 1 above.

b. Billing. Charges are billed on a monthly basis. If Qwest Corporation provides your regular (wireline) telephone service, charges for Service will appear on your regular telephone bill unless you request a separate bill. You must notify Qwest promptly of any change in your billing address. Your bill will not include incoming Caller ID information or any information that is blocked or otherwise unavailable to Qwest. If your Service Plan provides unlimited monthly minutes, your bill will have no call detail information, except for applicable roaming and long-distance charges. (Your call detail is available at www.myqwest.com excluding incoming Caller ID information or any information that is blocked or otherwise unavailable to Qwest.) Long-distance, roaming, and "caller-pay" charges are itemized separately, if applicable.

c. Late Payments; Billing Issues. If you fail to pay any charges by the due date, Qwest may, without notice, place restrictions on Service, change your Service Plan, charge an administrative fee for late payment, or suspend or terminate your Service. Checks returned to Qwest will incur a return fee that will be added to your charges. You will waive any claim for any billing error or improper charges unless you notify Qwest in writing within 60 days of the date of the invoice.

d. Special Provisions for Roaming Usage and Billing. Roaming calls may not be applied or billed in the monthly billing cycle in which they were actually made or received, due to a delay in reporting between carriers. In that event, such calls will be billed in the monthly billing cycle in which Qwest receives information about the calls, and this may cause the amount of charges to be higher for that month. Where applicable, roaming calls may not be included in your minutes of usage check due to delayed reporting from other carriers.

e. Special Provisions for Home/Office Link and Call Forwarding. Calls forwarded from your Wireless Phone to another phone using Home/Office Link or Call Forwarding will be treated as wireless calls in accordance with your Service Plan. This means they will use monthly plan minutes or incur roaming or additional minutes charges, as applicable, even if forwarded to a wireline phone.

f. Taxes and Fees. Various taxes and fees (e.g., universal connectivity charge) are imposed by governments relating to the Service we provide to you, goods or services you purchase, and the wireless network and equipment used in providing the Service. You are responsible for paying these taxes and fees, regardless of whether they are assessed on you or Qwest. You agree to provide Qwest with your place of primary use ("PPU"), which must be the residential or business street address where you primarily use your wireless service and which must be within our licensed service area, and to notify Qwest of any changes in your PPU. If you do not provide Qwest with an appropriate PPU, we may reasonably designate one for you. If you provide an address (such as a P.O. Box) that is not a recognized street address or does not identify the taxing jurisdictions applicable to the address, you may be assigned a default location for assessing taxes and fees, which may result in a higher or lower charge for certain taxes and fees. You have 60 days from the date of the first bill that contains disputed taxes and fees to notify Qwest or you waive your right to dispute those taxes and fees.

4. Service Availability; Roaming. Service is not available in all areas. Your Service Plan applies to a primary coverage area ("Home Coverage Area") in which the network is generally available and you may utilize all the features and benefits of your Service Plan if you are on the network. See coverage maps included with your Wireless Phone and on our Web site at www.qwestwireless.com. Coverage maps are an approximate representation of Home Coverage Areas and the network, not a guarantee of Service or network availability. Actual coverage may vary, depending on terrain, weather, equipment or other circumstances. You may be unable to access the network, even in your Home Coverage Area. If you are unable to access the network, or if you are outside of your Home Coverage Area, you may be able to use your Wireless Phone by "roaming." Roaming is not available in all areas and roaming coverage is subject to change without notice. You may or may not receive calls while roaming. When you are roaming, your Service Plan features and billing advantages may not apply and additional roaming charges, which are subject to change without notice, may apply (depending on your Service Plan), plus any applicable long-distance charges. The following types of roaming charges may apply:

a. Roaming Off-Network. Roaming on another wireless carrier's network (whether you are within or outside of your Home Coverage Area) where there is a roaming agreement with the other carrier is known as Roaming Off-Network. Roaming Off-Network is automatic roaming and is charged on your Qwest bill at the per-minute Roaming Off-Network rate set forth in your Service Plan. Your Wireless Phone is set to allow Roaming Off-Network. If you do not wish to incur charges for Roaming Off-Network, consult your Wireless Phone's user manual for instructions on disabling the automatic roaming feature. Note that if you disable the roaming feature, you will only be able to place calls on the network (and you may still incur charges for Roaming On-Network unless you avoid such charges as set forth below). Your Wireless Phone is equipped to indicate when you are Roaming Off-Network (see manufacturer's materials for details), but you are responsible for Roaming Off-Network charges even if your Wireless Phone does not indicate you are Roaming Off-Network.

b. Manual Roaming. If there is no roaming agreement with another wireless carrier, you may be able to use another carrier's network by manual roaming, which means you will be required to provide a credit card number to which the call will be billed at the carrier's roaming rate. If you do not provide a credit card number, you will be unable to place the call and will avoid the manual roaming charges.

c. Roaming On-Network. Using the network when you are outside of your Home Coverage Area is known as "Roaming On-Network". Roaming On-Network is automatic roaming and is charged on your Qwest bill at the per-minute Roaming On-Network rate set forth in your Service Plan. Your Wireless Phone is set to allow Roaming On-Network. You are unable to disable Roaming On-Network, and your Wireless Phone will not indicate when you are Roaming On-Network. To avoid Roaming On-Network charges, do not use your wireless phone outside of your Home Coverage Area. (Note that you may still incur Roaming Off-Network charges, whether you are within or outside of your Home Coverage Area, unless you have disabled it as set forth above.).

5. Service Usage. You are responsible for all usage and associated fees for the Service, whether or not you have authorized such usage. Service is provided only for your use and you may not resell, assign, or transfer your rights associated with the Service. You may not use the Service in a manner that violates the law. If Qwest has reason to suspect improper or fraudulent usage of the Service or interference with the Service network, Qwest may immediately, without notice or liability, deactivate or terminate Service. If you suspect fraudulent use of your Service, you must contact Qwest immediately at 1 800-879-0611 or call 611 from your Wireless Phone. Qwest may refuse, limit, interrupt, or curtail Service as it deems necessary to protect its interests.

6. Wireless Phones and Phone Numbers. The Wireless Phone has been programmed to work with the Service only, and Qwest has no obligation to reprogram it to work with another carrier's service. Qwest is not responsible for changes to the wireless system that may make the Wireless Phone obsolete or require a different phone. All phone numbers for Service are the property of Qwest and may be changed by Qwest at any time with advance notice.

7. Voice Messaging. Voice messaging mail boxes that are not initialized within 30 days of Service activation may be deleted along with any messages left in them. We may limit the number of messages you can retain. New or saved voice messages may generally be retained for 30 days and are deleted on the 31st day. Lost or deleted voice messages or greetings are irretrievable. Audible or visual indicators of messages may not always be accurate or up to date. In certain instances, you may be required to manually reset or clear your message indicator. Qwest is not responsible for the content of any voice messages you receive, or for any lost, missed, or deleted voice messages or outbound greetings, regardless of cause.

• Special Provision Regarding Voice Messaging Security. Certain Web sites may provide a means for unauthorized parties to access your wireless voice messaging account, listen to your new and saved messages, and/or place outbound calls through your voice messaging account using your Service. Access to your voice messaging account can be protected with a passcode, but this protection may be compromised if you utilize the "Skip Passcode" feature to access your wireless voice messaging account from your Wireless Phone without entering your passcode. Qwest recommends that you disable the "Skip Passcode" feature. Consult your Wireless Phone's user guide or contact Qwest for instructions. Qwest is not responsible for unauthorized access to your wireless voice mail account.

8. Data Services. If you use the Service in connection with any data service ("Data Service"), including but not limited to Two-Way Text Messaging and Sprint PCS VisionSM ("PCS Vision"), the following terms and conditions apply in addition to the rest of this Agreement and any terms and conditions of a third-party service provider, information provider or aggregator ("Provider").

a. Equipment; Availability. A data-capable Wireless Phone is required for use of a Data Service, and a PCS Vision–enabled Wireless Phone is required to use PCS Vision. Use is subject to any software, memory, storage or other limitation in the Wireless Phone or other equipment. Not all applications and services work, or work the same, on all data-capable Wireless Phones. You may be unable to use Data Services in all areas, even when you are in your Home Coverage Area and on the network. Data Services may not be available when you are off the network. If you use a Data Service outside of your Home Coverage Area or off-network, roaming charges and any additional long-distance charges may apply. You may be unable to receive calls when using Data Services.

b. Charges; Cancellation. You are responsible for all use of a Data Service on your Wireless Phone, whether or not you have authorized such use. You must immediately notify Qwest if you suspect unauthorized use. You will be billed for Data Services on your Qwest bill at the rates in effect when you subscribed, which may be changed by Qwest upon 30 days advance written notice. Use of Data Services may or may not use monthly minutes; additional minutes or roaming charges (including any applicable long-distance charges) may apply. Check our Web site for specific Data Service details. You may cancel any Data Service at any time by notifying Qwest as set forth in section 12(d) below, and you will be liable for all charges incurred through the date of deactivation.

c. Confidentiality and Security. You are responsible for maintaining the confidentiality of any account number, e-mail address, user ID, and/or password associated with a Data Service. Qwest will have no liability for unauthorized access to your Data Services account or for the security of any information you send, receive or maintain in connection with a Data Service. Qwest may access and disclose any such information as it deems necessary to comply with applicable laws and government orders or requests, to provide, operate and/or maintain the Data Services and related systems, and/or to protect its interests. Qwest is not responsible for the content of any messages you send or receive. Qwest will take reasonable measures to provide security when you are using a Data Service, but Qwest does not guarantee secure service or secure servers, including any data on the servers, even if the service or servers are described as "SECURE." Qwest will not be liable for any security or lack of security related to Data Services, servers or data. Accessing or using third-party sites or services in connection with a Data Service may require the disclosure of information about you, subject to the policies of those sites and services, and you accept all responsibility for disclosing such information. You consent to receiving advertising, warnings, alerts and other messages, including broadcast messages. Not all Data Services are encrypted and Qwest does not recommend sending highly sensitive information using any Data Service.

• Special Provision Regarding E-mail Addresses: Your e-mail address for PCS Vision or Two-Way Text Messaging includes your wireless phone number, which means that if you send e-mail using these services, or use the services to access a public Internet site (such as a chat room), your wireless phone number will be publicized to others. This may lead to unsolicited calls or other consequences. You accept all responsibility for any such consequences and release Qwest, and hold it harmless, from any and all liability arising out of or related to use of your wireless phone number in this e-mail address and your use of the PCS Vision or Two-Way Text Messaging service.

d. Providers. Certain services, information, data and messages you may use or receive in connection with a Data Service are provided by various Providers that may have proprietary interests in the information provided. You may not reproduce, retransmit, disseminate, sell, distribute, publish, broadcast, circulate or commercially exploit the information in any manner without the express written consent of Qwest and the relevant Providers. You may not use such information for any unlawful purpose. You must comply with any reasonable written request from Qwest to protect a Provider's rights to the information. While Providers are believed to be reliable, Qwest does not guarantee the accuracy, completeness, timeliness, or correct sequencing of any information they provide. Data Services are not intended to provide tax, legal, investing or other advice. Qwest is not responsible for content, opinions, advice, accuracy, timeliness, correct sequencing, completeness or usefulness of any information, applications or messages sent or received via a Data Service, delay in transmission of, or failure to receive, any information, or for any resulting losses or damages. Qwest has no duty to monitor, review, question or take any action based on any information transmitted through any Data Service.

e. Downloads. PCS Vision service may allow you to access or download content (such as games, ring tones and screen savers) for an additional charge, which will be billed on your Qwest bill at the rate specified at the time of access or download. Such charges are in addition to your regular monthly charges for PCS Vision. Qwest provides no warranties and makes no representations or claims with regard to any third-party services or content. Qwest may, under certain circumstances, delete items downloaded to available storage areas (e.g., your vault), including any pictures, games and other content. Qwest may limit the amount of downloadable content you may purchase. Qwest may, but has no obligation to, suspend your use of downloadable content without prior consent or notice if we suspect improper, fraudulent or unauthorized use.

• Special Provision for Multimedia Services. Subscribers to PCS Vision service on a multimedia-enabled Wireless Phone may be able to download video programming. Such programming requires you to subscribe to individual channels on a monthly basis at an additional monthly charge for each channel subscription you elect that will be billed to you on your Qwest bill. Each channel subscription will continue on a month-to-month basis until you cancel it via your Wireless Phone. (Please see your Wireless Phone's user guide or contact Qwest for details on canceling a subscription.) Cancellation of an individual channel subscription is not immediate; it is effective at the end of the current subscription period and will not be prorated. For example, if the channel was purchased on March 3, and you terminate the channel subscription on April 25, the channel will be available until May 3, and you will be responsible for all charges through that date.

f. Restrictions. You may not use a Data Service for any unlawful or abusive purpose, including but not limited to unsolicited mass e-mail messages (spam), use or attempt to use another person's account or service without authorization, or abuse or interfere with another person's use of or the security of any Data Service account. Data Services may not be used for or with server devices or host computer applications, other systems that drive continuous heavy traffic or data sessions, or as substitutes for private lines or frame relay connections. Data Services may not be used with "unlimited minutes" Service Plans as a modem in connection with other equipment (e.g., computers, PDAs, etc.), through use of connection kits or other phone-to-computer/PDA accessories, or Bluetooth® or other wireless technology. Qwest may, in its sole discretion, suspend or terminate access to a Data Service in the event of suspected or actual misuse, with or without notice, without liability to Qwest. Reproduction, retransmission, dissemination, and/or sale of Data Services are prohibited.

g. E-mail, Short Mail, and Two-Way Text Messaging. We may limit the number of characters available for e-mail and other messages you send or receive using a Data Service. We may also limit the number of such messages you may retain, or the length of time they may be retained. Check our Web site to confirm any current limitations. Audible or visual indicators of messages may not always be accurate or up to date. In certain instances, you may be required to manually reset or clear your message indicator. If your Wireless Phone or Service is unavailable when you receive a message, the message may be saved and redelivered for up to 72 hours and may be deleted or erased thereafter. Deleted and erased messages are not recoverable.

• Special Provision Regarding Two-Way Text Messaging. Two-Way Text Messaging is included with every Wireless Phone that is text messaging–capable, and all customers with such phones have the ability to send and receive text messages. No monthly subscription is required for this service and there is no recurring monthly charge, but each inbound and outbound text message is billed on a per-message basis as follows: (i) a message to multiple recipients is billed as a separate message for each recipient; (ii) an undelivered message may be billed at the applicable per-message rate, and (iii) cumulative charges for text messages sent and/or received in a given month will not exceed the maximum monthly charge set forth in your Service Plan. You are responsible for all charges for messages sent to or from your Wireless Phone, whether you authorized such messages or not, unless you contact Qwest to have Two-Way Text Messaging disabled. Please see your manufacturer's user guide for additional instructions on using Two-Way Text Messaging. For information regarding current Two-Way Text Messaging rates and maximum monthly charges, please see www.qwestwireless.com or contact Qwest at 1 800-244-1111.

9. NO WARRANTIES. QWEST MAKES NO EXPRESS WARRANTIES REGARDING THE SERVICE OR THE WIRELESS PHONE. QWEST DISCLAIMS ANY IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NO PERSON IS AUTHORIZED TO MAKE ANY WARRANTY ON BEHALF OF QWEST. QWEST IS NOT THE MANUFACTURER OF THE WIRELESS PHONE.

10. LIMITATION OF LIABILITY. QWEST AND ITS EQUIPMENT AND SERVICE SUPPLIERS, AGENTS AND DISTRIBUTORS WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE (INCLUDING PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE OR ECONOMIC LOSS) RESULTING FROM ACTS OR OMISSIONS OF ANOTHER SERVICE PROVIDER, SERVICE INTERRUPTION OR UNAVAILABILITY, EQUIPMENT OR NETWORK FAILURE, FAILURE TO COMPLETE CALLS, INCLUDING FAILURE TO COMPLETE EMERGENCY (e.g., 911) CALLS, RECEIPT OF UNSOLICITED MESSAGES, LOST VOICE MESSAGES OR GREETINGS, UNAUTHORIZED ACCESS TO VOICE MESSAGES, DATA, FILES OR EQUIPMENT, LACK OF PRIVACY, DELAYS IN THE TRANSMISSION OF ANY SIGNAL, OR USE OF THE SERVICE OR WIRELESS PHONE. YOU AND QWEST EXPRESSLY WAIVE TO THE FULLEST EXTENT ALLOWED BY LAW ANY CLAIMS TO RECOVER FROM THE OTHER PARTY OR ITS AFFILIATES OR AGENTS PUNITIVE, EXEMPLARY, SPECIAL, TREBLE, CONSEQUENTIAL, INDIRECT OR INCIDENTAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS OR LOST REVENUES) OR ATTORNEYS' FEES. You agree to defend, indemnify and hold Qwest, any underlying carrier, and any of Qwest's officers, directors, employees, agents and affiliates harmless from and against any and all claims, actions, liabilities, costs or damages, including reasonable attorneys' fees, brought by or on behalf of third parties relating to this Agreement and your use of the Service or Wireless Phone.

11. Resolution of Disputes. Except as set forth in the last sentence of this provision, any dispute or claim arising out of or relating to this Agreement, the Service or Wireless Phone will be resolved by binding arbitration, and both you and Qwest expressly waive any right to file or pursue any claim in court or to have any claim decided by a jury. Before commencing arbitration you must first present any claim or dispute to Qwest in writing to allow Qwest the opportunity to resolve the dispute. If the claim or dispute is not resolved within 60 days, you may request arbitration. The arbitration will be conducted in Denver, Colorado, in accordance with the Wireless Industry Arbitration Rules of the American Arbitration Association (“AAA”), except as modified by this Agreement. The Federal Arbitration Act will govern the arbitrability of all claims or disputes. Colorado law, without regard to choice of law principles, will otherwise govern and apply to any and all claims or disputes. You and Qwest expressly waive any right to pursue any claims on a class or consolidated basis or in a representative capacity, regardless of any AAA rules. Judgment on any arbitration award may be entered in any court having jurisdiction. Notwithstanding this provision, you and Qwest may seek relief in a small claims court for disputes or claims within the scope of its jurisdiction.

12. Miscellaneous.

a. Privacy. Qwest will not be liable for any lack of privacy you may experience while using the Service or Wireless Phone. You authorize Qwest to monitor and record your calls to Qwest concerning your account or Service. Qwest has the right to intercept and disclose any transmissions over its facilities to protect its rights or property.

b. Compatibility with Certain Equipment. The network and some PCS Vision phones may be incompatible with Text Telephone devices (TDD or TTY) used by those with speech or hearing disabilities to communicate by telephone. Such devices may not function effectively, or at all, for 911 calls due to the equipment or software of the answering agency, so they should not be relied upon for 911 calls.

c. Capacity. You represent that you are over the legal age of consent and legally competent to enter into this Agreement.

d. Notices. Written notice to you will be effective 3 days after the date they are deposited in the U.S. Mail addressed to your address in our records. You must notify Qwest of any changes in your address. Written notice to Qwest will be effective when received by Qwest. Oral notices to Qwest will be effective when reflected in our records. Your notice must specify your account number and Wireless Phone number.

e. Entire Agreement. This Agreement, together with any other documents expressly made a part of this Agreement, constitute the entire agreement between you and Qwest, which may be amended only as described in this Agreement. This Agreement supersedes any inconsistent or additional representations or promises that may have been made by any of Qwest's representatives, agents or distributors. This Agreement is subject to any applicable federal and state law.

f. Severability. In the event that any provision of this Agreement is held to be void, voidable, or unenforceable, the remaining provisions of this Agreement will remain in full force and effect.

g. Changes to this Agreement. Qwest may amend the terms and conditions of this Agreement at any time. Any changes to this Agreement are effective when we provide you with written notice as set forth in section 12(d) above. If you use the Services or make any payment to Qwest on or after the effective date of the changes, you accept the changes. If you do not accept the changes, you may terminate this Agreement by giving Qwest written notice (subject to Section 3 above). For purposes of the Agreement, "use" includes keeping the right to access the Service by not terminating the Service.

h. Additional Terms and Conditions. In addition to the terms and conditions set forth in this Agreement, specific terms and conditions apply to certain services such as Roadside Assistance and Handset Insurance; these are printed in your "Start Calling" user guide or provided when you subscribe to these services.
